These Terms of Service (“Terms”) govern your use of kellyadams.au (the “website”) and any products, resources or services provided by The Designed Life, operated by Kelly Adams (ABN 81 623 495 205) (“we”, “us”, “our”).

By using the website or booking any of our services, you agree to these Terms. If you don’t agree, please don’t use the website or services.

1. Who we are and what we offer

The Designed Life provides self-development and business-design content and services, which may include a free self-audit, downloadable resources, email content, and paid one-to-one sessions such as a Design Audit, Half-Day Strategy and Full-Day Intensive (“Services”). Details and pricing are set out on the website and may change from time to time.

2. Eligibility

You must be at least 18 years old to use the website and Services, and you agree that the information you provide to us is accurate and current.

3. Free resources and the self-audit

Our free self-audit and resources are provided for general information and personal reflection only. The self-audit is scored in your own browser; we don’t collect or see your individual answers. Free resources are provided “as is” and you use them at your own discretion.

4. Bookings, payments and pricing

  • Prices for paid Services are shown on the website and, unless stated otherwise, are in Australian dollars and include GST.
  • Payment is required as set out at the time of booking. Your session is confirmed once payment and a booking time are received.
  • We may update prices and offers at any time, but changes won’t affect bookings already confirmed and paid.

5. Cancellations, rescheduling and refunds

  • If you need to reschedule, please give us at least 48 hours’ notice and we’ll do our best to find a new time.
  • Cancellations made with at least 48 hours’ notice may be rescheduled or refunded at our discretion.
  • Cancellations with less than 48 hours’ notice, or missed sessions (“no-shows”), are generally non-refundable.
  • Nothing in this section limits any rights you have under the Australian Consumer Law (see section 10).

6. Nature of our Services — important disclaimer

Our Services are designed to support you in reflecting on, and designing, your work and life. They are coaching, education and strategy services, and:

  • they are not financial, legal, medical, psychological or therapeutic advice, and are not a substitute for advice from a qualified professional;
  • we don’t guarantee any specific result, income, or outcome — your results depend on your own circumstances, decisions and actions; and
  • you remain responsible for your own decisions and how you apply anything discussed.
If you need professional advice (financial, legal, medical or mental health), please consult an appropriately qualified professional.

7. Intellectual property

All content on the website and in our resources and Services — including text, frameworks (such as “The 5 Designs”), graphics, logos and materials — is owned by us or our licensors and is protected by copyright and other laws. You may use our free resources for your own personal, non-commercial use. You may not copy, reproduce, resell, distribute or create derivative works from our content without our written permission.

8. Acceptable use

When using the website and Services, you agree not to:

  • use them for any unlawful, harmful or fraudulent purpose;
  • attempt to disrupt, damage or gain unauthorised access to the website or its systems; or
  • copy, scrape or misuse our content or another person’s information.

9. Your content and communications

If you provide us with information, feedback or materials, you grant us permission to use them as needed to provide the Services and respond to you. You’re responsible for ensuring anything you share with us is accurate and that you have the right to share it.

10. Australian Consumer Law

Our Services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under that law. Where we are permitted to limit our liability, we do so as set out below.

11. Limitation of liability

To the maximum extent permitted by law, and subject to section 10:

  • the website, resources and Services are provided “as is”, and we don’t guarantee they will be uninterrupted, error-free, or suitable for your particular purpose;
  • we are not liable for any indirect, incidental or consequential loss, or for any loss arising from your reliance on our content or your own decisions; and
  • our total liability to you for any claim is limited, at our option, to re-supplying the relevant Service or refunding the amount you paid for it.

12. Third-party links and tools

The website may link to or rely on third-party websites and tools (for example, our booking, payment and email platforms). We’re not responsible for the content, availability or practices of those third parties, and your use of them is subject to their own terms.

13. Privacy

Your use of the website and Services is also governed by our Privacy Policy, which explains how we handle your personal information.

14. Changes to these Terms

We may update these Terms from time to time. The current version will always be posted here with its “last updated” date. By continuing to use the website or Services after changes are posted, you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
